1. Premesse e Accettazione
L'utilizzo dell'applicazione mobile "Legacy Box" (di seguito "App") implica l'accettazione integrale, incondizionata e vincolante dei presenti Termini e Condizioni e dell'Accordo di Licenza per l'Utente Finale (EULA). Se l'utente non concorda con il presente documento, è tenuto a disinstallare l'App.
2. Licenza d'Uso (EULA per Apple App Store e Google Play)
Il presente EULA è stipulato esclusivamente tra l'Utente e gli Sviluppatori di Legacy Box, e non con Apple Inc. o Google LLC. L'App è concessa in licenza, non venduta, per uso personale e non commerciale. Apple e Google non sono responsabili per l'App, per il suo contenuto o per i servizi di supporto e manutenzione. Apple e Google sono terzi beneficiari di questo EULA e avranno il diritto di farlo valere contro l'Utente. L'Utente dichiara di non trovarsi in un Paese soggetto a embargo da parte del Governo degli Stati Uniti e di non essere inserito in liste di soggetti vietati.
3. Natura del Servizio e Limiti
Legacy Box fornisce un servizio di archiviazione crittografata "time-capsule" per messaggi video (limite massimo 250MB per file). Non è un servizio di cloud storage sincronizzato o di backup continuo. I file vengono conservati sui server fino alla data di sblocco stabilita. Oltre i 30 anni non è possibile garantire la consegna a causa dell'imprevedibilità degli sviluppi tecnologici.
4. Crittografia, Sicurezza e Smarrimento Credenziali (Clausola Essenziale)
L'App utilizza sistemi di crittografia. La "Password Personale" scelta dall'Utente è l'unica chiave di decrittazione. Zero-Knowledge: Legacy Box non memorizza, non trasmette e non ha alcun accesso alla Password Personale dell'Utente. Perdita dei Dati: In caso di smarrimento della Password Personale o della "Chiave di Sistema", il video rimarrà permanentemente illeggibile. Legacy Box non può forzare lo sblocco, recuperare i dati o ripristinare le password. L'Utente accetta questo rischio esonerando Legacy Box da qualsiasi responsabilità per la perdita definitiva del contenuto, fatti salvi i casi di dolo o colpa grave.
5. Responsabilità sui Contenuti (User Generated Content)
L'Utente è l'unico proprietario e responsabile dei contenuti caricati. È severamente vietato caricare: Materiale pedopornografico, illegale, osceno o che inciti alla violenza e all'odio. Materiale protetto da copyright di terzi. Codice dannoso o malware. Legacy Box si riserva il diritto di sospendere l'account, cancellare i file e segnalare alle autorità competenti qualsiasi violazione di questa clausola, collaborando pienamente in caso di indagini.
6. Limitazione di Responsabilità e Manleva
L'App è fornita "così com'è" (As Is). Legacy Box non garantisce che il servizio sarà ininterrotto o privo di errori. Legacy Box non è responsabile per la mancata consegna fisica o digitale della "Chiave di Sistema" al destinatario, che è onere esclusivo dell'Utente. Legacy Box non risponde di mancate ricezioni di notifiche causate da filtri anti-spam, provider terzi, o cambi di indirizzo email/numero di telefono dei destinatari.
7. Pagamenti, Spazio Allocato e Rimborsi
I pagamenti sono processati dal provider terzo "Stripe". Legacy Box non conserva dati finanziari sensibili. Il pagamento copre l'allocazione dello spazio server (infrastruttura Google Firebase) per il periodo di tempo selezionato. Non sono previsti rimborsi una volta completata la transazione e generata la Chiave di Sistema, inclusi i casi di cancellazione anticipata della capsula da parte dell'utente o smarrimento delle credenziali.
8. Legge Applicabile e Foro Competente
I presenti Termini sono regolati dalla Legge Italiana. Per qualsiasi controversia, se l'Utente è qualificabile come Consumatore (B2C), il Foro competente è quello del luogo di residenza o domicilio dell'Utente. In tutti gli altri casi (B2B), il Foro competente in via esclusiva è il Foro di Roma (Italia).
9. Risoluzione delle Controversie (ODR)
Ai sensi dell'art. 14 del Regolamento (UE) n. 524/2013, si informa l'Utente Consumatore che è disponibile la piattaforma europea per la risoluzione online delle controversie (ODR), consultabile al seguente link: https://ec.europa.eu/consumers/odr.
1. Introduction and Acceptance
The use of the mobile application "Legacy Box" (hereinafter "App") implies the full, unconditional, and binding acceptance of these Terms and Conditions and the End User License Agreement (EULA). If the user does not agree with this document, they must uninstall the App.
2. License of Use (EULA for Apple App Store and Google Play)
This EULA is concluded strictly between the User and the Developers of Legacy Box, and not with Apple Inc. or Google LLC. The App is licensed, not sold, for personal, non-commercial use. Apple and Google are not responsible for the App, its content, or maintenance and support services. Apple and Google are third-party beneficiaries of this EULA and will have the right to enforce it against the User. The User declares not to be located in a country subject to a U.S. Government embargo and not to be listed on any prohibited party lists.
3. Nature of the Service and Limits
Legacy Box provides an encrypted "time-capsule" storage service for video messages (maximum limit 250MB per file). It is not a synchronized cloud storage or continuous backup service. Files are stored on servers until the scheduled unlock date. Beyond 30 years, delivery cannot be guaranteed due to the unpredictability of technological developments.
4. Encryption, Security, and Loss of Credentials (Essential Clause)
The App uses encryption systems. The "Personal Password" chosen by the User is the sole decryption key. Zero-Knowledge: Legacy Box does not store, transmit, or have any access to the User's Personal Password. Data Loss: In case of loss of the Personal Password or the "System Key", the video will remain permanently unreadable. Legacy Box cannot force unlock, recover data, or reset passwords. The User accepts this risk, exempting Legacy Box from any liability for the permanent loss of content, except in cases of willful misconduct or gross negligence.
5. Content Responsibility (User Generated Content)
The User is the sole owner and responsible for the uploaded content. It is strictly forbidden to upload: Child pornography, illegal, obscene material, or material inciting violence and hate. Copyrighted material belonging to third parties. Malicious code or malware. Legacy Box reserves the right to suspend the account, delete files, and report any violation of this clause to the competent authorities, fully cooperating in case of investigations.
6. Limitation of Liability and Indemnity
The App is provided "As Is". Legacy Box does not guarantee that the service will be uninterrupted or error-free. Legacy Box is not responsible for the failure to physically or digitally deliver the "System Key" to the recipient, which is the User's exclusive responsibility. Legacy Box is not liable for missed notifications caused by anti-spam filters, third-party providers, or changes to the recipients' email addresses/phone numbers.
7. Payments, Allocated Space, and Refunds
Payments are processed by the third-party provider "Stripe". Legacy Box does not store sensitive financial data. Payment covers server space allocation (Google Firebase infrastructure) for the selected timeframe. No refunds are provided once the transaction is completed and the System Key is generated, including cases of early cancellation of the capsule by the user or loss of credentials.
8. Applicable Law and Jurisdiction
These Terms are governed by Italian Law. For any dispute, if the User qualifies as a Consumer (B2C), the competent court is that of the User's place of residence or domicile. In all other cases (B2B), the exclusive competent court is the Court of Rome (Italy).
9. Dispute Resolution (ODR)
Pursuant to Art. 14 of Regulation (EU) No 524/2013, the Consumer User is informed that the European platform for Online Dispute Resolution (ODR) is available at the following link: https://ec.europa.eu/consumers/odr.
